DISTANCE SALES AGREEMENT

ARTICLE 1 — PARTIES TO THE AGREEMENT

1.2. BUYER (CONSUMER) INFORMATION:

The individual or legal entity purchasing digital services or subscriptions via the website https://creatorry.com. The contact details, email, and billing information provided by the Buyer during registration and checkout shall be deemed authoritative.

ARTICLE 2 — SUBJECT OF THE AGREEMENT

The subject of this Agreement is to determine the rights and obligations of the Parties in accordance with the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts (published in the Official Gazette dated 27.11.2014, No. 29188) regarding the sale and delivery of digital services (AI-powered generation of music, images, videos, avatars, and related subscription plans/credits) ordered by the Buyer electronically from the website https://creatorry.com.

ARTICLE 3 — PRODUCT / SERVICE DETAILS & PRICING

1. Services Description: The Seller provides cloud-based Software-as-a-Service (SaaS) allowing users to access AI models for generating digital content (music, lyrics, images, avatars, videos) and related credit packages or subscription tiers.
2. Pricing & Payment: The fees, subscription plans, credit allocations, and applicable taxes are clearly specified on the checkout page before payment confirmation. All transactions are processed securely via authorized payment gateways.
3. Recurring Subscriptions: If the Buyer purchases a recurring subscription plan, the fees will be automatically billed to the Buyer's payment method at the beginning of each billing cycle (monthly or annually) until cancelled by the Buyer via their account dashboard or by contacting support.

ARTICLE 4 — DELIVERY OF DIGITAL SERVICES

The products and services offered under this Agreement are intangible digital goods delivered instantly online. Upon successful payment verification, access to the platform, credits, or subscription features shall be instantly activated under the Buyer's registered user account at https://creatorry.com.

ARTICLE 5 — RIGHT OF WITHDRAWAL & EXCEPTIONS (REFUND POLICY)

1. General Principle: Pursuant to Article 15/1-ğ of the Regulation on Distance Contracts (Mesafeli Sözleşmeler Yönetmeliği m. 15/1-ğ), "Contracts for services performed instantly in electronic environment or intangible goods delivered instantly to the consumer" are exempt from the statutory 14-day right of withdrawal.
2. Application to Digital Services: Since the services provided on Creatorry.com involve instant digital access, token/credit allocation, and automated AI compute power execution upon user command, the statutory right of withdrawal does not apply once the digital service or credits have been used or accessed.
3. Refunds & Cancellation:
   • Buyers may cancel recurring subscriptions at any time. The cancellation will take effect at the end of the current paid billing period, and no further automatic charges will occur.
   • Refunds for unused plans or technical errors may be granted at the Seller's sole discretion upon written request to support@creatorry.com.

ARTICLE 6 — GENERAL RIGHTS & OBLIGATIONS

1. The Buyer agrees and warrants that all information (name, address, payment details) provided during registration and order placement is accurate, complete, and up to date.
2. The Seller reserves the right to suspend or terminate accounts in cases of fraudulent payment attempts, breach of Terms of Service, or illegal use of generated content.
3. The Seller shall ensure continuous access to the services, subject to necessary maintenance, security upgrades, or force majeure events beyond reasonable control.

ARTICLE 7 — GOVERNING LAW & DISPUTE RESOLUTION

This Agreement is governed by and construed in accordance with the laws of the Republic of Türkiye. In the event of any dispute arising out of or in connection with this Agreement, Consumer Arbitration Committees (Tüketici Hakem Heyetleri) up to the monetary limits established annually by the Ministry of Commerce, and Consumer Courts (Tüketici Mahkemeleri) of Antalya, Türkiye shall have jurisdiction.

ARTICLE 8 — EXECUTION

By completing the payment procedure on https://creatorry.com, the Buyer is deemed to have read, understood, and irrevocably accepted all the terms and conditions of this Distance Sales Agreement. This Agreement enters into force immediately upon electronic approval and payment confirmation.
